CANCELLATION POLICY

Cancellation fees will be assessed to compensate Contractors for time commitments towards working, and time invested in making arrangements to avail themselves to claim & work shifts posted on the SnapShyft platform by approved Businesses (Venues). Each work opportunity/shift posting using the SnapShyft platform will clearly state the cancellation policy. Both Venues and Contractors will be alerted through system notifications when either attempts to cancel a shift or remove themself from a work opportunity.

Cancellation fees may be assessed in the following situations:

  • For any shifts that are posted to the marketplace AND THEN CLAIMED by a Contractor, should a Venue elect to cancel at any point within 24 hours of shift start time, Venue will be charged at a minimum of four (4) hours at the indicated rate, plus standard applicable SnapShyft fees (e.g. booking fee, etc). The Contractors on the SnapShyft Platform often arrange their work schedule to accommodate picking up open shifts from the marketplace, so when a Venue elects to cancel a shift the Contractors are out not only time but potentially have lost out on other available work opportunities. There are no cancelation charges for shifts cancelled greater than 24 hours of shift start.
  • For any shifts that have NOT BEEN CLAIMED by an available Contractor and are cancelled within one (1) hour of shift start time, Venue will be charged a $15 cancellation fee. This is to cover costs associated with specific and unique targeted marketing of work opportunities to Contractors on the SnapShyft Platform.
  • Should a Venue attempt to alter a work opportunity or change the work position, after a Contractor has arrived on site to perform work as indicated in the work opportunity they originally claimed, the Contractor can decline and will receive full compensation for the agreed work opportunity, at the agreed shift length and rate;
  • In the case of a Venue ending a shift early, without a valid cause related to performance, for any shifts that are concluded earlier than the original posted shift length, the hours charged and then paid out to the Contractor will be rounded up to match the original shift length; however
  • Should a Venue end a shift early due to closing early, or because a client ends an event early, for any shifts that are concluded earlier than the original posted shift length Contractor will only be paid for actual hours worked, or a minimum of four (4) hours, which ever is greater; however
  • Should it be determined that a Venue purposely misleads, misstates, or otherwise attempts to entice Contractors to claim/work their work opportunities through false advertising (Bait & Switch) such as increasing shift length, only to cut them loose early, Venue will be charged the full shift length as originally posted, at a minimum rate of $15 per hour (or the original posted pay rate, which ever is greater); however
  • Should a Contractor be dismissed due to poor job performance, Contractor will only be paid for actual hours worked; and
  • Should a Contractor elect to conclude a shift prior to the agreed upon time in the original shift posting, Contractor will only be paid for actual hours worked.

Contractor Penalties may be assessed in the following situations:

  • Should a Contractor claim a work opportunity but then elect not to show up to the job (NO SHOW), Contractor will be immediately suspended from using the SnapShyft platform, and will remain in suspended status without legitimate cause, or without valid, verifiable, and justifiable reasons or documentation supporting their inability to show up to work, or to effectively communicate in a timely manner. There is zero-tolerance for no-call-no-shows, which are grounds for immediate and permanent removal from the SnapShyft Platform.
  • Should a Contractor claim a shift but then drop the shift at any point within 2 hours of shift start, the Contractor will be assessed penalties that may result in suspension or removal from the SnapShyft Platform. To avoid penalties and/or suspension, Contractor must provide satisfactory evidence to support their decision. The decision to implement penalties and/or suspension is at the full discretion of the SnapShyft Review Team.
  • Should a Contractor arrive on site but then abandon a shift at any point (walk-off) without legitimate cause, or without valid, verifiable, and justifiable reasons, the Contractor will be assessed penalties that will result in suspension, and potentially permanent removal, from the SnapShyft Platform. To avoid penalties and/or suspension, Contractor must provide satisfactory evidence to support their decision. The decision to implement penalties and/or suspension is at the full discretion of the SnapShyft Review Team.
  • Should a Contractor’s behavior inhibit or prevent others from successfully using the SnapShyft platform, such as through claiming & holding onto shifts only to release them at any time before scheduled shift start time; or by claiming any and all open shifts, preventing others from being able to do so, whether Contractor intends to work each shift or not; or Contractor displaying a history of frequent dropped shifts, two-hour threshold notwithstanding; or by claiming open shifts Contractor is not expressly qualified to perform at a high level, including— not possessing requisite licenses, certifications, permits, or training; not having proper positional attire/not meeting dress code requirements; not having relevant experience in the specific role and environment a shift takes place; not being capable of performing the role as intended for the duration indicated/scheduled; or not exhibiting professionalism at any point in time with all parties, then Contractor will face penalties as listed below. Measures will be taken to combat such behavior.

Contractor penalties may include:

  • temporary suspension of worker account, pending review
  • limited access to future work opportunities
  • service interruption fees up to $500 per instance
  • permanent removal from the SnapShyft Platform

Commitment is paramount to maintaining a dynamic and robust marketplace. Claiming a shift equates to making a commitment to the Venue posting the work opportunity; and when a Contractor claims a shift, the business is making a commitment that they will not alter, modify, or otherwise try to tamper, dissuade, or manipulate Contractor into performing duties beyond the general scope of a role or job.

The SnapShyft operations team actively monitors each posted shift and all activity on the marketplace, and will take steps as needed to ensure a fair and equitable marketplace for our users. Additionally, the operations team may, at its discretion, put forth additional enticement efforts as needed to aid in the coverage of shifts.

In many instances where shifts are dropped by a Contractor, there are other qualified Contractors on the waitlist for the opportunity to work the shift, and they will get first option on claiming any dropped shifts.

SnapShyft reserves the right, in its absolute discretion, to withdraw or to modify this Cancelation Policy at any time without prior notice and with no liability.
